To secure your date in my diary, simply read through the booking terms and conditions below, and complete the boxes at the bottom. Once I've received notification of this, and payment of the booking fee, your date is secure and booked in my diary. I can't wait to work with you.



Packages are delivered with an online gallery of at least 500 retouched, colour corrected, high resolution images ready to print




ENTIRE AGREEMENT: This agreement contains the entire understanding between Esme Whiteside trading as Esme Whiteside Photography and The Client. It supersedes all prior and simultaneous agreements between the parties.

2. FEES: Upon receiving the £250 booking fee Esme Whiteside Photography will reserve the date agreed. For this reason, the deposit is non-refundable. The Client understands and agrees that the remaining balance described in the contract is due 30 days before the wedding date. 


3. EXPENSES: The Client is responsible for any other costs associated with the wedding such as venue entrance fees or parking fees. A simple 'suppliers meal' is requested by Esme Whiteside photography, for all full day bookings.


3(a). DESTINATION WEDDING EXPENSES: In the case of the wedding taking place outside of the UK, clause 3(a) shall come into effect. The Client will be responsible for covering all expenses including return flights/train tickets, bag check-in, airport transfers and accommodation costs which will be included in the flat fee charged by Esme Whiteside Photography. Esme Whiteside Photography is responsible for booking all Flights, accommodation and transfers, which have been paid by the client in the agreed flat fee package. Esme Whiteside Photography will send proof of booking to The Client.

4. CANCELLATION: If the Client cancels the wedding or the wedding photography package outlined in this contract, the booking fee will not be refunded. If the wedding is cancelled within 6 months of the date 50% of the balance is owed, if cancelled within 8 weeks of the date of the wedding 100% of the balance is still owed, to account for loss of earnings. Should the client postpone the wedding for no more than 3 months, then subject to availability, all monies paid may be applied to the new wedding date.


5. INSURANCE: Esme Whiteside trading as Esme Whiteside Photography is insured for public liability up to £2 million. It is The Client’s responsibility to check that this level of cover meets the requirements of the venue(s).

6. VENUE & REGISTRAR RULES: Esme Whiteside Photography is limited by the guidelines of the ceremony official and venue(s) management. The Client agrees to accept the results of their imposition on the photographer(s). Negotiation with officials for moderation of guidelines is The Client’s responsibility.

7. COOPERATION: The parties agree to positive cooperation, communication and punctuality. Esme Whiteside Photography is not responsible for individuals’ failure to be present or to cooperate, neither for missed images due to the ceremony or reception starting late or details not known by the photographer. It is recommended that The Client designate a ‘wedding helper’ to point out individuals for group photographs, as the photographer(s) will not be held accountable for missing desired people or gathering people for the photograph(s). The Client should make the photographer(s) aware in advance if any guests will have difficulty standing or using steps so that alternative arrangements can be made. 

8. GUEST COOPERATION: It is understood by The Client that guest conduct that interferes with photography may affect the quality of the photographs taken and increase the number of times they must be re-taken. The Client is responsible for notifying guests to not use their own photographic equipment in a way that restricts the photographer(s). Children must be supervised at all times and must not be permitted to interfere with photographic equipment. Esme Whiteside Photography will not tolerate verbally or physically abusive behavior, or deliberate damage to photographic equipment.


9. BREAKS: Esme Whiteside Photography will take short convenience breaks and will endeavor to schedule breaks at times convenient to The Client. The photographer(s) will take a food break when The Client and the guests are eating. Esme Whiteside Photography politely requests that a simple meal is provided for the photographer(s), as Esme Whiteside Photography can accept no responsibility or liability for photographs missed due to photographer(s) sourcing their own food.


10. MODEL RELEASE: The Client hereby grants Esme Whiteside Photography the unrestricted right to photograph all guests at the wedding. The Client hereby assigns and grants Esme Whiteside Photography the rights to use and publish photographs for editorial, trade, advertising or any other purpose and in any manner and medium and to alter the same without restriction. Esme Whiteside Photography may display and use the photographs taken for advertising, website and internet promotion, photographic contests, public display, photography books, store fronts, window displays, studio display, television advertising, magazine advertising, blog submissions, blog advertising, social media and any other purpose thought proper by Esme Whiteside Photography.

11. COPYRIGHT: The 1998 Copyright, Designs, and Patents Act assigns copyright to Esme Whiteside Photography. Under this contract The Client is permitted to print, edit, crop and share copies of photographs for personal use. The Client may not use the photographs taken under this contract, or allow copies to be made photographically, electronically, or by any other means for other purposes (e.g advertising) unless agreed with Esme Whiteside Photography beforehand.

12. CREATIVE LICENCE: Esme Whiteside Photography shall be granted creative and artistic license in relation to the choice of locations, poses used, photographic style and post-processing style. Judgement on photographic style and the number of photographs taken shall be deemed correct. Esme Whiteside Photography will try to honour requested photographs, but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

13. PROFESSIONAL IMAGE MANIPULATION: Esme Whiteside Photography undertakes some professional image manipulation that includes red eye removal, colour correction, artistic effects, minor skin retouching etc. Image manipulation and editing is completed at the discretion of Esme Whiteside Photography and the photographer’s creative license and the technical limitations with regards to image manipulation shall be deemed correct.


14. IMAGE DELIVERY: Esme Whiteside Photography will provide the client with high-resolution JPG images as outlined in the specified package. The number of edited images included shall be deemed correct. RAW images or unedited images will not be supplied by Esme Whiteside Photography.

15. GALLERY COMPLETION: Esme Whiteside Photography will provide The Client with a gallery of high-resolution images no later than 8 weeks after the wedding. The Client is free to print,copy and share the images for personal use without hindrance.

16. ALBUM COMPLETION SCHEDULE: If an album has been ordered, Esme Whiteside Photography will provide The Client with the specification of album that has been outlined within the wedding photography contract. The Client will choose photographs and Esme Whiteside Photography will design the album to the wishes of The Client until a proof design has been agreed by both parties. The Client must agree the final design by signing an acceptance form, as no changes can be made once the album has gone to print. The Client understands that external album suppliers are used and that production and delivery times are out of the photographer’s control. The album manufacturer reserves the right to change album specifications without prior notice and in this event, Esme Whiteside Photography will recommend a suitable alternative. If the alternative is not accepted by The Client, liability shall be limited to a refund of monies paid for the album only.

17. PRINT ORDERS: Prints and other photographic display products may be ordered after the wedding and the current fees at the time of ordering will apply.


18. STORAGE OF PHOTOGRAPHS: Esme Whiteside Photography requests that The Client and their guests place orders for prints, additional USBs, additional albums and other photographic display products within 12 months after the wedding date. Whilst Esme Whiteside Photography strives to store photographs indefinitely, The Client accepts that after their USB stick and album (if applicable) has been delivered, no further guarantee is made on the storage of photographs. Esme Whiteside Photography advises The Client to back up their photographs once they have received their gallery.

19. PRE-WEDDING SHOOT: If outlined in the contract, the pre-wedding/engagement shoot is an additional part of the contracted wedding photography package and cannot be exchanged for other services. Esme Whiteside Photography reserves the right to arrange pre-wedding shoots to suit schedule and workload.

20. LIMIT OF LIABILITY: In the unlikely event of death, medical or accidental emergencies or natural disasters, it may be necessary to find an alternative photographer. Esme Whiteside Photography will make every effort to secure a replacement photographer able to provide a similar package. It is The Client’s responsibility to pay the new photographer’s fees should they be more than the current fees. If a suitable replacement is not found, responsibility and liability is limited to the return of all monies paid including deposit. In the unlikely event of Esme Whiteside Photography being late to the wedding due to death, medical or accidental emergencies, natural disasters, fire, flood, severe weather conditions, transport breakdown or delay, severe traffic conditions or other unforeseen circumstances, responsibility and liability is limited to the return of all monies paid including deposit. Esme Whiteside Photography takes the utmost care over the transportation, processing, storage and back-up of photographs; including using professional grade equipment, backup equipment, hardware and software. However, in the unlikely event of The Client’s photographs being lost, stolen or destroyed for reasons beyond Esme Whiteside Photography’s control including total photographic failure, the latter’s liability is limited to the return of all monies paid including deposit.

21. NON-GUARANTEE: Although every possible care will be taken to produce photographs of all important and special events during the wedding, Esme Whiteside Photography cannot place an unconditional guarantee on the above. Esme White Photography is not responsible for acts of nature, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers, and/or conditions beyond Esme Whiteside Photography’s control that may affect the fulfillment of the contract. 

22. SEVERABILITY: If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect.

23. AMENDMENTS: Only changes or modifications specifically placed in writing or via email and accepted by The Client and Esme Whiteside Photography shall be recognised as amendments to this contract.


24. RIGHT OF WITHDRAWAL: Changes to agreed circumstances, locations, facilities or times; non-cooperation; and/or late payments, may result in the withdrawal of this contract.

25. DISPUTE RESOLUTION: In the unlikely event of a dispute arising in connection with this contract, both Esme Whiteside Photography and The Client undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation.


I have read and understood the terms above. I hereby agree to the terms of this agreement and I understand that this contract comes into effect immediately.
